1. Trial period
The first 4 lessons are agreed as a trial period. During the trial period, either party is entitled to terminate the teaching contract without notice. The termination must be made in writing to be effective.
2. Duration of the contract
The lessons are concluded for an indefinite period.
3 Subject matter
The teacher shall provide lessons for the student in the subject of drums, classical percussion, mallet instruments and percussion.
4 Termination / Termination of contract
4.1 The teaching contract can be terminated by either party with a notice period of 2 months to August 31 (end of the school year).
4.2 Both contracting parties are entitled to terminate the teaching contract for good cause.
4.3 Any termination must be made in writing to be effective.
5 Public holidays, vacations
There are no lessons on public holidays and during vacations at general education schools in the state of Bavaria.
6 Fee / due date
6.1 The monthly fee for pupils up to the age of 18 is as follows:
6.2 The fee is an annual fee, which is calculated for 36 lessons per calendar year and is payable in twelve monthly installments.
6.3 If the student receives fewer than 36 teaching units, the teaching units not given but paid for will be reimbursed by the teacher; the provision contained in clause 9.1 remains unaffected by this. If the student receives more than 36 teaching units in a calendar year, the additional units are to be paid by the student to the teacher in addition to the monthly rate after the teacher has settled the account. If the teaching contract begins during a calendar year, the above regulations apply pro rata temporis.
6.4 The annual fee is payable in 12 equal installments, which are also payable during the school vacations. The first month is calculated pro rata temporis. The installments are due for payment by the 10th of each current month at the latest.
6.5 The parties agree that the teacher may adjust the agreed fee on October 1st of each calendar year. The adjustment must be communicated to the contractual partner in writing at least eight weeks before this date. The contractual partner has the right to terminate the teaching contract within one month of receipt of the fee adjustment with extraordinary effect from October 1st of the calendar year. If the contractual partner does not terminate or does not terminate in due time, the fee adjustment shall be deemed approved.
7. Place of instruction, time of instruction
7.1 Lessons take place on the premises of the Stadtkapelle Schongau e.V. (Bürgermeister-Lechenbauer-Straße 2, 86956 Schongau).
7.2 The teacher gives the student one lesson per week. The lessons are given as individual lessons. The dates of the lessons will be set by personal arrangement with the teacher.
7.3 Lessons can also be held online.
8 Cancellation of lessons
8.1 If the teacher is unable to attend, the contracting parties shall agree on an alternative date. Should this not be possible, the teacher shall reimburse the pro rata fee.
8.2 Lessons canceled by the student are forfeited if the teacher is paid at the same time.
8.3 If lessons are canceled due to illness of the teacher, they are not to be made up once per semester.
8.4 The student undertakes not to attend lessons if he/she is ill, as there is an immediate risk of infection for the teacher.

9. Duties of the teacher, duties of the student; teaching material
9.1 The teacher is fully responsible for providing appropriate and regular instruction.
9.2 The student undertakes to attend lessons regularly and to practise at home to the extent necessary.
9.3 Teaching materials such as sheet music and instruments shall be provided by the student at his/her own expense.
10. Performance in public
The pupil should only take part in public performances after prior consultation with the teacher.
